  • Component 1   ( 3 Articles )

    Component 1 - Integrating environmental issues into strategic planning

    Component 1 focuses on three main issues:

    1. Capacity building in Strategic Environmental Assessment (SEA) methodology including possible use of river basin modelling to support SEA;
    2. Development of environmental action plans at national and provincial levels; and
    3. Development of SEA decree and guideline as well as implementation of SEA into government policies, plans and programs.

    Purpose of Component 1

    The purpose of this component is that:

    “Environmental aspects are merged into national strategic plans and that MONRE’s role in this is recognized by Ministry of Planning and Investment and other concerned line ministries”.

    The specific indicator for the component purpose is that MONRE is actively involved in integrating environmental interests into the socio-economic planning system and into strategic plans of line ministries and their revisions (e.g. number and quality of MONRE interventions in SEA and planning processes in other ministries and/or large project).

    Also the relevance of the Environmental indicators in the latest NSEDP and its revisions will be evaluated.

    Approach

    The approach in this component is to strengthen the sector specific expertise in MONRE so that it can contribute valuable inputs to the planning processes of other ministries. In order to support ownership of SEA within concerned line ministries, a newly created working group with representatives from all the line ministries will act as the basis for development of the legal basis, development of guidelines, and for training and implementation of SEA in the daily work. The SEA activities will concentrate on recently developed plans and programs and their midterm updates. Gradually, the activities will move on to address plans, which are under preparation and for which SEA could provide valuable contributions.

    In accordance with these expected future roles and responsibilities, EMSP will train relevant MONRE and line ministry departments in the SEA procedures and techniques. This will include training of trainers to support continuous training in SEA in the future.

    Results

    1. GOL capacity in SEA methodology is developed and utilized by MONRE, MPI and line ministries;
    2. The Environmental Strategy updated and Environmental Action Plans prepared and implemented in a participatory manner;
    3. SEA is applied to the socio-economic plan, urban planning and sector planning on the national level according to agreed procedures.

    Component 2 - Environmental certification, monitoring and enforcement of environmental conditions

    The focus of this component is to support and improve the regulation and monitoring of major industrial and development projects in Lao PDR. Mining and hydropower sectors are the booming sectors from which the government hopes to collect revenues for the country and thus the project must emphasise these sectors accordingly in addition to industrial and infrastructure projects mentioned in the original Project Document.

    Based on completed baseline studies among the industries, experiences from cooperation with the MoIC and continuous demand for support in EIA report reading at MONRE show that support to basic skills development is still needed. Therefore, the original plan presented in the Project Document of mainly on-the-job training will be supplemented with workshops and more intensive environmental/technical training.

    MoIC has a functioning cleaner production program and sees that inclusion of activities related to cleaner production is not necessary in EMSP. Activities supporting MoIC should thus focus on promoting self-monitoring (SM) and environmental management systems (EMS) in industry.

    Objectives

    The purpose of this component is that the environmental impacts of major mining, hydropower, industrial and infrastructure projects are properly regulated and monitored by MONRE and DONREs. Specific indicators for the component purpose are:

    1. Percentage of major projects with relevant, enforceable environmental conditions from all major projects;
    2. Number of inspection reports;
    3. Number of mechanisms for submitting and following up complaints about environmental nuisances which are established, communicated and available to all interested groups and persons affected by major projects.

    The long term goals of Component 2 are that major development projects in Lao PDR do not cause excessive negative environmental and social impacts and that any such impacts are mitigated effectively. Furthermore, that communities potentially affected by major development projects have access to efficient grievance mechanisms.

    Approach

    The approach in this component builds on the achievements of SEM II and other donor interventions in the field of ESIA capacity building. The project design relies heavily on intensive technical and environmental training along with on-the-job training through sector specific technical and legal assistance in real cases of licensing, compliance monitoring and enforcement.

    Compliance with environmental regulations is also facilitated by supporting good practices in self-monitoring and safe chemical management in industry to complement end-of-pipe pollution control measures. Partnership and division of tasks between MONRE and MoIC is bridged by sponsoring these promotion activities through MoIC. In addition, studies will be conducted and initiatives taken to support the sustainability of inspection and monitoring tasks in MONRE.

    Results

    Results under Component 2 are:

    1. Good practices are applied in preparing environmental certificates;
    2. Sustainable inspection and compliance enforcement system for environmental conditions and standards is in place;
    3. Polluting industry is practicing self-monitoring (SM) and using environmental management systems (EMS) to control hazardous emissions;
    4. The financial sustainability of compliance monitoring has improved.

    The first two results form a logical approach from the procedure of issuing certificates into inspections and enforcement. Result 3 connects MoIC into the activities, mainly concentrating on capacity building in the industrial sector. The last result aims at achieving financially independent, transparent and sustainable compliance monitoring.

    Risk mitigation

    The risks and assumptions for Component 2 evolve around support from the Provincial Governors, good coordination and collaboration between MONRE and concerned line ministries including clarification of division of labour in licensing and inspection. There are also issues related to cooperation with the private sector and other donor funded projects.

    Support from the Provincial Governors will be sought through entering into agreements and through openness and attention to the specific environmental context and issues in the concerned provinces. The Provincial Administrations will also be involved in implementation of activities and they will be participating in annual evaluation and planning workshops.

    The division of labour in terms of licensing and inspection is an integral part of the Component where the execution of licensing and inspection activities will contribute to clarifying the required improvements and this will be brought forward in the ongoing process of formulating rules and regulations.

    Cooperation with the private sector mainly refers to supporting industries in establishing self-monitoring and environmental management systems. The approach is to select cooperation partners together with MOIC and in close collaboration with GIZ SME carefully based on trust and commitment and to encourage their participation through offering training and recommendations. Additional approaches such as selecting pilot industries among those most interested and capable of implementing proactive environmental management measures will be explored once implementation is underway and collection of baseline information has been finalized.

    Component 3 - Strengthening Environmental Management at the Provincial Level

    Objectives

    The immediate objective of this component is that the Provincial Departments of Natural Resources and Environment (DONREs) are capable of conducting their tasks according to their legal mandate in an effective manner.

    The specific indicators for the component purpose are:

    1. Number of significant environmental impacts investigated, reported and followed up by DONREs
    2. Number of inspections conducted by DONREs according to agreed procedures
    3. Number and quality of IEE certificates prepared by DONREs according to agreed procedures


    Approach

    The approach to capacity building in Component 3 is to address both institutional and human resources capacity building. This will be undertaken through the following areas of activities:

    - PEAP

    - Implementation and monitoring of two demonstration projects

    - Intensive training on environmental monitoring and inspection

    - Intensive training course on water quality monitoring

    - Training on IEE through selected cases (to be conducted as a part of demonstration project and with cooperation with C2)

    - Monitoring missions to 17 provinces

    - Long term training through scholarships

    Component 4 - Environmental data and information services

    Component 4 focuses on assisting MONRE in developing its information management and improving its capacity to communicate through the use of tailored tools and cost effective information campaigns. This includes developing both the information infrastructure and the institutional capacity in terms of staff communication skills.

    The main change in Component 4 compared to the original Project Document is inclusion of environmental indicators and the preparation of State of Environment (SoE) Report in this component instead of in Component 1. MONRE’s Environment Data and Information Management Division (EDIM) is foreseen to be the custodian and coordinator of activities leading to the results of Component 4 and this Division is also already familiar with indicators and SoE reporting. These tasks link closely to databases and web tools.

    Component 5 - Environmental Laboratory Service

    Component 5 supports MONRE in monitoring environmental quality and emission standards through enhancing its capacities in obtaining reliable data, field sampling and laboratory analysis in accordance with recommended procedures stated in standard methods. The objective of this component is to establish a National Environmental Laboratory (NEL) to provide laboratory services on ambient environmental quality and emissions and discharges to the environment, mainly in the water quality sector. In the long run, the laboratory is foreseen to operate on a semi-commercial basis.

    During the inception period, the approach and work plan has been reviewed and brought up to date particularly with respect to timing of laboratory construction works. This means that the laboratory building project funded by the World Bank has been delayed from the original timetable, which affects the EMSP project planning and timing. NERI as the responsible partner for both the laboratory construction project and for Component 5 in EMSP will cooperate closely with the World Bank in terms of the laboratory construction project and ensure coordination with EMSP activities.

    Laboratory building project will effect on the timetable of EMSP with its finishing time. Equipment purchase, quality training and analytical actions have to be synchronized with the laboratory building project. Anyhow, activities in Component 5 can be planned and rescheduled according to the construction work for coming years and project timetable will be sharpened according to laboratory building project. Progress in building the actual premises for the laboratory with the support of WB will inevitably affect also the level of achievement in laboratory activities during the project time. Potential delays in the construction works will reduce resources available for development of quality assurance procedures and analytical development during the project span.

    Due to the already known and potential future delays in the construction works, it has become necessary to modify the proposed sequence of activities as well as to prepare to cut time available for some activities (e.g. activating the production of analysis at the laboratory may be shortened notably). In order to mitigate possible problems caused by the delays a step by step approach will be used to reach the results. During the construction works focus will be on capacity building activities (e.g. training on sampling methodologies and procedures, and some specific laboratory activities in other facilities). Also activities related to the development of national water monitoring program can be started during the first year. Through these modifications the preparedness and skills of laboratory staff is ensured already before laboratory starts its operations.

    Component 6 - Programme Management

    Objectives

    Component 6 is the Programme Management Component entrusted with the responsibility to ensure good coordination among all five components, programme beneficiaries, line agencies, local and central government. Component 6 is also responsible for financial and assets managing, monitoring of the programme, preparing work plans and reporting the progress to MONRE and the donor. Furthermore, Component 6 is responsible for facilitating all components in terms of organizing training programmes, workshops, procurement of equipment and recruiting national consultants and programme support staffs.

    Approach

    Training on Financial and Vehicle Management Regulation (FVMR) for MONRE and DONREs staff has been carried out during the past work plan period. However, due to restructuring of MONRE and in order to ensure effective implementation of the Demonstration Projects, the training on FVMR, Operational Manual (OM) and procurements will be continued for MONRE and PNREDs staffs so that all involved have common understanding on FVMR, OM and procurement procedures.

    The CC meetings including pre-CC meetings are tentatively scheduled to be held in March and October 2012 for discussing progress and reviewing and approving budgets and work plans. The joint progress and coordination planning with DONREs and international organizations/line ministries workshop will be held during January – February 2012 pending the restructuring of the DONREs. These two workshops have been postponed from the period of second six months 2011. In addition, in order to monitor programme implementation, a permanent MONRE monitoring committee will be established and convene every 2 months to review the progress of the programme.

    Based on lessons learnt during first year of programme implementation the time consuming preparation of monthly progress report will be changed to preparation of quarterly progress reports; however, financial reports will be prepared and submitted to MFA on a monthly basis. The support to DoE staffs (12 persons) will be also continued.
